PERC E-Filing Terms of Use

For any documents filed electronically through the PERC E-Filing system, the party attempting to file bears the risk that the documents will not be timely received or will not be legible, regardless of the cause. If the uploaded document is not received in legible form, filing will not be perfected.

E-FILINGS SHOULD NOT CONTAIN “SENSITIVE PERSONALLY IDENTIFIABLE INFORMATION” (SPII) THAT IS NOT ESSENTIAL TO THE MATTER AT ISSUE

Please redact or remove any non-essential sensitive personally identifiable information before uploading an E- Filing. Examples of documents that may contain SPII include payroll records, medical records, bank statements, tax records, etc. If you believe you must file documents with the Agency that contain unredacted sensitive personally identifiable information, understand that documents filed with the agency may be automatically forwarded to everyone listed as a party to the case, and may be subject to public records disclosure.

E-FILINGS MUST BE TIMELY

Parties and Party Representatives are encouraged to e‐file materials in advance of any statutory filing deadline to avoid problems with transmission or receipt of a filing.

Filing is complete when a legible copy of the document is successfully uploaded to the e-filing system. Service is complete upon receipt of the entire electronic transmission by the recipient. The metadata created by the successful transmission of the email will serve as the record of the time of service.

Filings submitted through PERC E‐File will be considered filed on the business day and time received, so long as it occurs during normal business hours. Filings received after business hours will be deemed as filed on the next business day.

ELECTRONIC FILING SUBMISSION

After submitting your case or document, you will receive a confirmation email from PERC.

ACCEPTABLE DOCUMENT FORMATS

The only format for submitting any documents by E-Filing is Adobe's Portable Document Format (.pdf).

If you have questions about submitting a document in a format that is not listed or expect to submit a large quantity of electronic records, please contact the PERC office at 360-570-7300 or filing@perc.wa.gov.

SERVICE OF CASES AND DOCUMENTS MUST BE COMPLETE

All case or document filings must comply with the service requirements in WAC 391-08-120. PERC is not responsible for service failure due to bad email addresses. The filing party is responsible for verification that all parties receive a copy of the case or document filed. The user bears sole responsibility to correct any defective filing submitted in PERC E‐File.


MAXIMUM SIZE OF FILES FOR UPLOAD

E-Filed documents must be less than sixty-five megabytes (65MB).

Public Users & Guests:

The case information accessed in E-filing is generated from system records maintained by PERC and is deemed to be public information. While efforts are made to ensure the data is accurate and current, it must be used by the recipient with the understanding that no warranties exist, expressed or implied, concerning the accuracy, reliability or suitability of this data and content. PERC Staff, agents, and the developers of this system and website assume no liability whatsoever associated with the use or possible misuse of the data contained herein.

The recipient is responsible for understanding the meaning of the case details obtained through PERC E‐File and for the appropriate and lawful use of such information.
